Terms and Conditions of Seller Sage

Please read these terms and conditions carefully before using Our Service.


Interpretation and Definitions

Capitalized terms have meanings defined below. These definitions apply whether singular or plural.

Definitions

For these Terms and Conditions:

  • Affiliate means an entity that controls, is controlled by, or is under common control with a party.
  • Country refers to the United States.
  • State refers to Washington.
  • Company (referred to as “Seller Sage,” “we,” “us,” or “our”) refers to Seller Sage (dba of CK Brands, LLC)
  • Device means any device that can access the Service.
  • Service refers to the Website.
  • Terms and Conditions (or “Terms”) refer to this agreement between you and Seller Sage.
  • Third-party Social Media Service refers to third-party platforms or content integrated into the Service.
  • Website refers to Seller Sage, accessible at https://sellersage.com/.
  • You means the user or entity accessing the Service.

Acknowledgment

These Terms govern your use of the Service and form a binding agreement between you and Seller Sage. By using our Service, you agree to these Terms. If you disagree, you must not use the Service.

You confirm you are over 18 years old. Seller Sage does not permit individuals under 18 to use the Service.

By purchasing our services (one-time or retainer), you consent to communication via phone or other means for support and service delivery. You also acknowledge that calls or meetings may be recorded for quality assurance.

Use of the Service also requires acceptance of our Privacy Policy. Please read it carefully.


Links to Other Websites

Our Service may include links to third-party websites. We do not control or take responsibility for their content, privacy policies, or practices.

We encourage you to review the terms and privacy policies of all third-party sites.


Termination

We may suspend or terminate your access to the Service at any time, without notice, for violations of these Terms.

Upon termination, your right to use the Service ends immediately.


Limitation of Liability

Our total liability, if any, is limited to the amount you paid for the Service. Seller Sage does not guarantee specific results from services or deliverables.

We disclaim liability for any indirect, incidental, or consequential damages—including lost profits, business interruption, or data loss—even if advised of such risks.


“AS IS” and “AS AVAILABLE” Disclaimer

Our Service is provided “as is” and “as available,” without warranties of any kind. We do not guarantee the Service will meet your expectations or be error-free.

We do not guarantee uninterrupted service, virus-free systems, or that all content is accurate or current.

Some jurisdictions do not allow limitations on certain warranties, so some exclusions may not apply to you.


Governing Law

These Terms are governed by the laws of the State of Georgia, USA. All disputes must be resolved in the courts located in King County, Washington.

Indemnification: You agree to hold Seller Sage and its team harmless from any claims arising from your use of the Service.


Disputes Resolution

If you have concerns or disputes, you agree to attempt resolution informally by contacting us first.


For European Union (EU) Users

EU consumers will benefit from any mandatory provisions of the laws of their country of residence.


United States Legal Compliance

You warrant that you are not located in a country subject to U.S. embargoes or listed on any U.S. government restricted parties list.


Severability and Waiver

If any part of these Terms is held invalid, the rest will remain in effect. Failure to enforce a provision does not waive the right to enforce it later.


Translation Interpretation

If these Terms are translated, the original English version shall prevail in case of discrepancies.


Terms Per Specific Services

General Disclaimer:
Seller Sage does not guarantee specific outcomes. Services depend on cooperation, information provided, and external platform policies (e.g., Amazon).

Service-Specific Terms:

  • Listing Reinstatement: One ASIN per marketplace, up to 8 hours. Project ends upon reinstatement.
  • UPC to GS1 Conversion: One ASIN per marketplace, up to 8 hours. Ends upon successful UPC change.
  • Account Suspension Reinstatement: One marketplace, up to 8 hours. Ends upon reinstatement.
  • Brand Name Change Tier 1: 1–10 ASINs, 8 hours allocated.
  • Brand Name Change Tier 2: 11–30 ASINs, 16 hours allocated.
  • Trademark Orders: Includes USPTO fee, TM research, and simple responses. Complex legal responses incur additional charges.

Delivery Times:
Some services may take 2–60 days. As long as Seller Sage is actively working, the payment terms remain in effect.

Refund Policy:
Orders are non-refundable unless explicitly stated:

  • Reinstatement Services: Non-refundable after appeal submission. 100% refund if no appeal is filed within 90 days and service is unsuccessful.
  • Creative Services: Limited to 3 revisions. Extra revisions billed at $300 each.
  • Coaching Calls: Non-refundable once booked. Must be used within 1–3 months. Unused hours expire after one year.

Max Billable Time:
A maximum of 8 hours per project applies unless otherwise agreed. Additional time may incur extra charges.

Communication Boundaries:
Website orders (excluding coaching) do not include calls. Calls requested beyond this scope may be billed at $400/hour.

Warranty Exclusions:
Services are iterative and may require adjustments. Seller Sage disclaims all implied warranties. No representative may override this disclaimer.


Non-Solicit Clause

Client agrees not to solicit, hire, or induce any employee, contractor, or subcontractor of Seller Sage during the term of service and for one year thereafter. Violations incur a fee of the greater of $10,000 or the individual’s annual salary. The restricted period will be extended if breached.


Changes to These Terms

We may update these Terms at any time. If changes are material, we will notify users 30 days in advance where possible.

Continued use of the Service after updates means you accept the new Terms.
